Judiciary of Kenya

The Judiciary is one of the three State organs established under Chapter 10, Article 159 of the Constitution of Kenya. It establishes the Judiciary as an independent custodian of justice in Kenya. Its primary role is to exercise judicial authority given to it, by the people of Kenya. The institution is mandated to deliver justice in line with the Constitution and other laws. It is expected to resolve disputes in a just manner with a view to protecting the rights and liberties of all, thereby facilitating the attainment of the ideal rule of law. The Judiciary and its related institutions (Judicial Service Commission (JSC), Kenya Law; previously National Council for Law Reporting (NCLR), Tribunals and the Judiciary Training Institute (JTI) perform the following functions; 1. Administration of justice 2. Formulation and implementation of judicial policies 3. Compilation and dissemination of case law and other legal information for the effective administration of justice The judicial system in Kenya is defined by 15 articles spanning from Article 159 (judicial authority) to article 173 (Judiciary Fund) contained in the new constitution of Kenya.


1. Resident Magistrate

No of Positions: 50

Job Summary

  • A Law Degree from any recognized University;
  • A Diploma from the Kenya School of Law or an exemption by the Council of Legal Education;
  • Admission to the Roll of Advocates;
  • Proficiency in computer applications;
  • Must not have any pending complaints with the Advocates Complaints Commission, the Disciplinary Committee or adverse report from current and previous employer(s);
  • Must possess the qualifications set out in Chapter Six of the Constitution of Kenya.

Experience:

Three (3) years post admission experience either in private practice or other employment and a current practicing certificate.

Responsibilities

  • Presiding over Resident Magistrate’s Court in any part of Kenya with jurisdiction as stipulated in various statutes;
  • Performing Deputy Registrars duties as stipulated in various statues;
  • Overseeing the operations of the court(s) and management of staff under his/her charge; and
  • Carrying out a wide range of administrative functions for those heading stations.

2. Executive Director, The National Council for the Administration of Justice (NCAJ)

Job Summary

  • A master’s degree in a relevant discipline from a recognised university
  • A Bachelor’s degree in Law or Social Sciences from a recognised university
  • At least fifteen (15) years previous working experience with at least five (5) years’ experience in a senior management position in a leading organization/ institution.
  • Knowledge and experience in Public Sector, Partnership development and activities that are aligned with the NCAJ mission and vision
  • Demonstrated success of effectively leading change, transformation and institutional/organisational growth.
  • Must be proficient in computer applications.
  • Meet the requirements of Chapter Six of the Constitution on leadership and integrity

Responsibilities

  • Under the guidance of the Council, provide the policy and strategic leadership for the NCAJ
  • Oversee the administrative and operational and financial efficiency and effectiveness of the NCAJ Secretariat,
  • Oversee and support the development, design and delivery of the Council’s Initiatives/programmes and ensure that the goals and objectives are aligned with the NCAJ Strategic Plan.
  • Oversee the development, implementation and reporting of the NCAJ Annual Budget,
  • Work Plans, and expenditures
  • Lead the execution of the NCAJ Strategic Plan and other institutional policies, rules and regulations
  • Ensure and facilitate successful collaboration between the NCAJ Council, Technical Committee, Working Committees and other ad hoc Committees that may be set up by the Council for the effective delivery of the NCAJ mandate.
  • Oversee the efficient and effective day to day operations of the NCAJ.
  • Ensure internal audit procedures are conducted on periodic and regular basis to ensure integrity of the Council operations and data as well as implementation of recommendations.
  • Be responsible for the management of staff, capacity building, motivation, performance management, policy formulation and implementation.
  • Oversee the building of long term relationship with all the Justice Sector stakeholders and key development partners.

3. Senior Officer Administrative

No of Positions: 30

Job Summary

  • A Kenya Cerificate of Secondary Education mean grade C- (Minus) with a C(plain) in English or its approved equivalent from a recognized institution; and A Diploma in Secretarial Studies from Kenya National Examination Council or equivalent qualification from a recognized institution.

OR

  • The following qualifications from the Kenya National Examination Council
    • Shorthand III (Minimum 100 w.p.m.)
    • Typewriting III (50 w.p.m)/Computerized Document Processing III
    • Business English III/Communications II
    • Secretarial Duties II
    • Office Practice II
    • Commerce II
  • Office Management III/Office Administration and Management III
  • Demonstrated merit and ability as reflected in work performance and results;
  • Proficiency in computer application skills; and
  • Meet the requirements of Chapter Six (6) of the Constitution.

Responsibilities

  • Taking dictation, transcribing and typing from drafts, manuscripts or recording from dictation machines ensuring accuracy in the work undertaken;
  • Facilitating and monitoring procedures for record keeping of correspondence and file movements;
  • Establishing and maintaining support services for the Office, including diary management, coordinating and collating all relevant paperwork;
  • Facilitating appropriate systems and ensuring processes are developed and maintained to support effective and efficient day to day running of the office;
  • Establishing a confidential and efficient filing system for the office ensuring data protection and compliance with records management policies and procedures;
  • Ensuring all scheduled meetings, including preparation of meeting papers, obtaining and preparing briefing materials and presentations, and taking minutes are in order;
  • Establishing and maintaining office diary and travel itineraries;
  • Facilitating effective Management of office protocol and etiquette, handling telephone calls, appointments, mails and responding to routine emails and correspondences; and
  • Liaising with internal functional units and external organizations;
  • Ensuring security and integrity of office data, records, equipment and documents, including classified materials.

4. Legal Counsel

Job Summary

  • Minimum of 9 years’ relevant experience in a Legal Environment;
  • At least 3 years in Middle Management Level;
  • Prior experience working on legal matters including but not limited to litigation, legal drafting, legal research and analysis shall be an added advantage.

Responsibilities

  • Conducting research on relevant laws and putting in place measures to implement policy decisions of the Judiciary;
  • Ensuring that the Judiciary complies with all applicable laws, regulations and procedures and continually update the Chief Registrar on any change of law;
  • Providing legal support to all the units under the office of the Chief Registrar;
  • Reviewing of legal documents with a view to ensuring that they comply with the law;
  • Undertake litigation in court cases for and against the Office of the Chief Registrar and the Judiciary;
  • Representing the Judiciary in Arbitral proceedings in matters where the Judiciary is a party;
  • Liaise with the Office of the Attorney General and External Advocates in matters where they are representing the Judiciary;
  • Undertake and oversee the preparation of conveyancing documents and processes for the Judiciary; and
  • Preparing and review of legal contracts.

Job Summary

  • Minimum of 9 years’ relevant experience in a Legal Environment;

Job Summary

  • A degree in Islamic Law or its equivalent from a recognized University/Institution;
  • Profess the Islamic faith;
  • Ability to effectively communicate in English, Kiswahili and Arabic;
  • Good conduct in accordance with the Islamic faith; and
  • Proficiency in computer applications.
  • Must not have any pending complaints with any Complaints Commission, the Disciplinary Committee or adverse report from current and previous employer(s);
  • Must possess the qualifications set out in Chapter Six of the Constitution of Kenya.

Responsibilities

  • Arbitration of disputes on inheritance, marriage and divorce in Muslim families;
  • Solemnizing and registering Muslim marriages;
  • Supervising pronunciation of Muslim divorces and registering them;
  • Signing of affidavits, declarations and agreements;
  • Translating Arabic related documents;
  • Supervising the registries under him in consultation with the Magistrate in-charge; and
  • Keeping records of all arbitrations and submitting returns of registered marriages and divorces to the Chief Kadhi.

7. Secretary, Political Parties Disputes Tribunal

Job Summary

  • Hold a degree in Law, Management, Administration or other Social Sciences, from a university recognized in Kenya.
  • Have a least ten (10) years proven experience at management level.
  • Meets the requirements of Chapter 6 of the Constitution of Kenya on leadership and integrity.

Responsibilities

  • Coordinate and manage the day to day affairs of the Tribunal
  • Drive the Tribunal’s vision through the implementation of its Programmes and plans.
  • Mobilize and manage the resources of the tribunal to achieve its core mandate.
  • Prepare the Tribunal’s annual plans and estimates.
  • Oversee financial and administrative management of the Tribunal.
  • Ensure financial reporting and accountability in accordance with the law, Government of Kenya procedures and guidelines of the Judiciary.
  • Provide requisite leadership to ensure the Tribunal attains a high level of competitiveness and ethical standards in its entire programmes.

8. Member, Political Parties Disputes Tribunal

Job Summary

  • Hold a Law Degree from a recognized university, or is an advocate of the High Court of Kenya, or possess an equivalent qualification in a Common-Law jurisdiction;
  • Possess at least seven (7) years’ experience as an Advocate of the High Court of Kenya; or as a distinguished academic in the legal field or legal practitioner or such experience in other relevant legal field or
  • Be a citizen of the Republic of Kenya;
  • In addition, the applicant must demonstrate a high degree of professional competence, communication skills, fairness, good temperament; good judgment in both legal and life experiences and commitment to public and community service.
  • Meets the requirements of Chapter 6 of the Constitution of Kenya.
  • The Member shall not be a Member of the Public Service and not be an active participant in the activities of a Political Party.

Responsibilities

  • Drive the Tribunal’s vision and mission through the implementation of its Programmes and Plans;
  • Mobilize and manage the resources of the Tribunal to achieve its core mandate;
  • Provide requisite leadership to ensure the Tribunal attains a high level of competitiveness and ethical standards in its entire programmes.
  • reside over all the proceedings where he/she is present in person with unlimited geographical and pecuniary jurisdiction on matters of disputes;
  • Participate in hearing and determination of all disputes which come before the full bench;
  • Enter judgments in default of appearance;
  • Determine and pronounce upon any point of law arising in the course of proceedings
  • before the Tribunal;
  • Approve, sign, issue and certify orders, decrees and certificates of costs, copies of proceedings and warrants of attachments for execution of Court decrees and orders; and
  • Write and pronounce awards, judgments, orders, rulings and decrees issued by the Tribunal.

9. JSC Representative to the Salaries and Remuneration Commission

Job Summary

  • holds a degree from a university recognized in Kenya;
  • has knowledge and at least ten (10) years’ experience in either finance and administration; public management; (ieconomics; human resource management; or labour laws;
  • meets the requirements of Chapter Six of the Constitution; and
  • has had a distinguished career in their respective fields.
  • The person should be someone who understands the historic needs of the Judiciary and capable of representing the interest of the Judicial Service Commission and the Judiciary.
  • A person is not qualified for appointment as Member of the Salaries Remuneration Commission if the person:
    • is a member of the Judicial Service Commission;
    • is a member of the Judiciary;
    • is an undischarged bankrupt; or
  • has been removed from office for contravening the provisions of the Constitution or any other law

Responsibilities

The JSC Representative to the Salaries and Remuneration Commission shall be responsible to the Judicial Service Commission and shall ascribe to the mandate and functions of the Salaries and Remuneration Commission which are provided under Article 230 of the Constitution and the Salaries and Remuneration Commission Act No. 10 of 2011.
